I bought some chandeliers from eBay the seller offered return so I wasn't happy with them and asked to return them he refused the case would one in my favour and the chandeliers were given to the charity shop down the road I check with eBay that this was ok to do and was told that because the case was in my favourite then I could do what I like with them as the seller has not responded. I have now been taken to court by the seller and I'm now in a civil court battle with him and he has got eBay to vouch that the chandeliers really good condition and has posted it attached to his statement I can not get hold of eBay and think it is essential to do so in this case as it is a legal matter and obviously eBay are involved

I would have thought that the sellers refusal to accept a return and messages from ebay should be printed and used in evidence. If you do not argue and put your side of the story the seller will win by default, but whether he can actually get any money out of you is another matter.

 

According to ebay rules, if a seller refuses a return then Ebay can force a repayment, it is the seller's own fault that he is wasting money on a Court Action. Seller had the option to supply a Reply Paid label but did not take advantage of it.

Do you still have the email/message from Ebay saying that the seller had not responded and they had found the case in your favour and you did not have to return them.   IF yes then print it off and use it as evidence in your case.

 

I have not heard of Ebay vouching that an item was indeed in good condition because Ebay themselves never ever get to see the item in dispute.  If that is a true statement then i am very very surprised.  That to me does sound wrong.

To be honest.........i strongly recommend that you get proper professional legal advice either through the Citizens Advice Bureau or  a local Solicitor.

As the matter is now  sub judice you should be taking legal advice and not be discussing it and asking for advice on a public forum. At the very least you must know whom you are getting advice from .
