Bought phone then seller told me it has scratches. Seller won’t refund and cancel the order

Hi. I bought a mobile phone and asked the seller if the screen was good condition. I was told that it had always had a screen saver on it and there were no scratches. He has now sent photos showing scratches on the screen  and I have asked him to cancel and refund but he's not responding other than saying it works ok and he needs the money. What can I do? I can't see how to request refund as it says return item, I've not even had the item. Any advice please?

If you have won and paid for this phone, and the seller declines to cancel, you can only wait until it arrives, and then use eBay's money back guarantee through the resolution centre if it doesn't match the description.
