Do you mean you've paid for it but they're refusing to post it *and* refusing to give you a refund?

 

In which case, give it about 3 days (to get to a reasonable time for it to have been delivered) then open an 'item not recieved' case.

If the seller can't provide a tracking number to prove he sent it and it's delivered, ebay will give you your money back.

You have 30 days after the sale date in which to do this.

You have been given good advice so far, so if you have not already done so by the time you read this reply follow the advice that you have already given you in order to secure a refund.

 

In addition to the information that @lucy_farmer has already given you, if you intend to leave the seller some negative feedback in relation to the transaction wait until eBay have closed the case in your favour and issued you with a refund before you do so.  The reason I say this is because if you left negative feedback before the case had been closed then the seller could potentially ask eBay to remove your feedback, arguing that you didn't give him or her adequate time to resolve the matter before leaving negative feedback.  Under these circumstances eBay may well remove your feedback, as eBay have been known to do this in the past when buyers have left negative feedback before the case has been closed.

 

In light of the advice given in the second paragraph of this response, if you hold off of leaving feedback until after the case has been closed the seller would have far less chance of being able to successfully persuade eBay to remove your feedback, especially if you had to escalate the case to eBay in order to secure a refund because the seller failed to do so within the alloted timeframe.
