Q. When is a delivery not a delivery?
A. When evri (ebay’s preferred carrier) dump your package “in a secure place” which:-
Evri are unable to tell you where the “secure place” is
May or may not be on your property
May be a dump for several packages handled by evri
Almost certainly is not “secure”

What the Evri tracking website show as "View Proof of Delivery" i.e. after entering your postcode?

I seem to remember reading (uk consumer law) says that if the courier leaves the parcel on your doorstep, in a communal hallway, or outside your building, or anywhere else it is not a secure delivery (unless you asked them to leave it there) if the parcel is stolen, the loss sits with the retailer, the retailer is responsible until the parcel is in your hands. 

 

So under those circumstances is it ebay who is responsible, or the seller ? 

 

You should be able to claim your money back under those conditions, evri possibly have a picture of the unsafe delivery,  if they have not still contact ebay and explain the situation to them. 

 

There is no reason why you should not get your money back, and if no one will return your money do a chargeback through your card company or bank.

And if you've bought something from a business or a business seller on ebay, you're absolutely right 👍

 

It's a bit different with private sales i.e. a private person selling a personally owned item to another private person. These sellers are not 'retailers' and things get a bit more complicated.

 

And now ebay have started using the 'Simple Delivery' system, which means ebay have taken over responsibility from private sellers over 'un-delivereds' (and also 'damaged-in-post' problems).

But the ebay computer generally takes the 'evidence' of delivery from the courier's tracking, which says 'delivered' .

And computer usually says 'no'. 

 

Which is why there's so much advice to go to your payment provider and do a charge back...
