If it's within the 30 day then just open a not as described claim and the seller will have to issue you a return label or refund you. Escalate to eBay as soon as possible if no action by the seller. Ignore all contact from the seller as they will try and get you to time out. If over the 30 days then do a chargeback with your payment provider

What date did item arrive as you only have 30 from date of receipt to make a claim.
(i'm taking it you opened a "not as described" claim).
If you are out of time try your payment provider if you paid via debit or credit card.

Must have been over the 30 days or you did another reason and not as described, you will have to contact your payment provider and do a chargeback. keep the proof it's stolen and you will win.
