Hello, I hope you can help me with my issue. I havent been able to engage in an appeals process. This is only one issue but I need to explain it in full, for my own sanity if nothing else.
I've had the email from Ebay saying I need to register as a business by Sept 4th. I am not a business seller so I requested a call from Cust services and got a call from a guy called 'Jose' in America. I explained that I'm selling my own 2nd hand stuff from my collection of Toys, Warhammer and other wargame stuff that I built up over my last fifty odd years of life.
As a bit of background. I'm a nerd who aways worked full time and lived alone. I had disposable income. So I used to fill my life with stuff. Toys ,comics, wargames miniatures and airsoft. I always used to move on stuff that I'd got bored with or no longer needed after a life changing illness.
But I really started clearing out most of my large collection of items 2 years ago after I had 2 mini strokes and was diagnosed with congenital heart disease and heart failiure. I figured that it would be better if I sell it, than rely on family who wont have a clue what it is or what it might be worth if the worst happens. I just didn't want it to go to landfill. The money has been useful to clear debts and helped with my day to day bills. I dont buy stuff to sell on for profit, I dont make anything to sell on for profit. HMRC do not say that my selling off my own old stuff is engaging in a business seeking profit. It says the opposite on their own online tool. I'm not doing anything wrong.
The email said I can appeal by clicking a link which just goes to the 'upgrade your account' page. So I requested a CS call back to ask how I make an appeal. He put me on hold for 2 mins and just said the appeal is denied!?! He claims the government has asked ebay to do this directly so I cant appeal.
I dont believe for a moment that HMRC contacted Ebay directly about me selling off my old action figures and toy soldiers.
He didn't really sound like he was knowledgeable on the UK situation, and I explained to him that I'd used the UK Gov's own website to see if I needed to be a business for tax.
As I'm selling off my own personal stuff that wasnt bought to sell for profit as a private individual, it said theres no tax to pay on it.
I wont register as a business because I'm not a business seller. I dont even meet the criteria on Ebays business seller page. It seemed that they are looking solely at amounts sold, and dont want to engage in anything else.
Which is just plain wrong. Just because I had a lot of stuff to move on, does not make me a business.
Is there any way to speak to a person who is both informed and can be bothered to look into my issue properly? Customer Services is just fobbing people off with pre prepared blanket statement because its too much work to look at an individual case. Its bad customer service that can have a real impact on someones lives. All I got from the Customer service rep was that I cant appeal and have no choice. Again, this is incorrect.
I just dont know where to turn with this, I'm completely stressed out. I didn't even get to make an appeal.
