I purchased an item recently which was clearly listed in both the photos and the written description as an original upol gravitex schutz gun but the sell sent me a very cheap unbranded underseal gun instead. I contacted the seller right away and have since put in for a refund due receiving an incorrect item. Still no reply. His listing states no returns but I have clearly been misled by the listing and mis-sold. I have tried to get ebay involved but haven't been able to get an contact with a human.

How do I proceed

after 3 days escalate the case to eBay.

Is that 3 days from receipt of the item or from my starting the refund

3 days after opening your case.

Did you open your case within 30 days of receipt?

 

If later then the option to escalate won't appear.

You are wasting your time contacting the seller and absolutely no need to contact ebay.

So long as you opened a Not as described case within 30 days, from then it js just follow procedure. 

Seller either pays for a return label, or refunds without return, if not on day 4 you escslate the case to ebay, who will force a refund, with no return necessary.

 

On every listing on the right side is a link to the money back guarantee, it does pay to read information supplied instead of thinking you have to contact ebay.
