Refund - Expired safety mask

Hi guys,

 

I bought a safety mask about 2 months ago here and after it arrived I realised that the description doesnt say if the mask is washable, reusable or not. I asked the seller but he couldnt give a definite answer. Then I tried to contact the company, who actually produce such masks and I got the following answer:

 

The mask type in question has been obsolete for around 11 years and any stock still existing will be at least 6 years beyond their expiry date. Even when they were available they were a single shift product and could not be cleaned and reused.

 

So basically I bought a product that had been expired already, which means that I might have risked my health during this pandemic. Since this is outrageous and unacceptable, my idea is to report the seller to Ebay, besides I want to ask for a refund without sending the item back.

 

My questions are as follows: Do you think my idea is right? How can I report the seller to Ebay and how can I ask for a refund without returning the item? Shall I contact the seller first?

You can't do anything on Ebay to get your money back as you're out of time (read the 30-day Money Back Guarantee - on every listing and in various other places across the site).  So open a NAD case on PayPal, and upload the information that the manufacturer has supplied. PayPal should refund you without the need for return, but will probably require proof that the mask has been destroyed first.

 

If the seller is a UK business seller, or an international seller with UK warehousing, you should report this to Trading Standards as a matter of urgency. TS will investigate, and advise Ebay accordingly.

 

In the meantime, report the listing if still live to Ebay as fake merchandise (there's a report button on every listing), and try to contact them too (though that is difficult at present) as one report won't hold much sway without actual proof. And leave appropriate feedback to warn others if you're still in time (you have 60 days in which to leave feedback).
