Lasting power of attorney?

Hi all,

Just popped in to see if there's anyone who could explain what a 'Lasting power of  attorney' is compared to the old Power of attorney? as I understand the law regarding this has been changed from the 1st of October? I find after searching Google, it's all so confusing!! any help anyone can give regarding what this involves would be appreciated.

Hi Barbara,

The old one was an "Endearing Power of Attorney" that ended in 2007, the one you get now is Lasting Power of Attorney.

I really am not sure what the actual differences are but I did become the one holding lasting power of Attorney for my dad about 2 years ago.

What I had to do was get his approval that I became his attorney, he had sign to that effect, witnessed by 2 individuals who had to be seperate from the family and who knew my Dad. You can have several appointees who can be either joint attorney's or acting seperately.

I/We had to get valid proof of him being of no mental capacity when we needed it activating to take over his affairs. Doctor did that by letter.

The papers have to be submitted for registration and then endorsed as valid and legal by a solicitor. It cost us a couple of hundred pounds to do it to.

You can download the forms but have to send them to a specific address by post to register them.

Sadly Dad passed away, last week, so the Lasting power of Attorney becomes void and wills or probate takes over.

Evoman, thank's for the link, I've been thrown in at the deep-end and have no experiance of dealing with matters such as this, it's so stressful my heads spinning!!

Busty, so sorry to hear your dad has passed away thanks for that information, every little helps to get through this minefield! Mum had a stroke last Wednesday, so I haven't had much time to look anything up.
