So I sold a headset on ebay and according to the tracking number, it says 'Delivery Attempted - No Answer'.
However the buyer has claimed they did in fact have the item and they tested it and was not working at all.
I have not tested it beforehand as I was selling on the behalf of my brother. I even told the buyer:
''it’s been in my brother's room for over a year so I know nothing about it sorry".
As I really did not know if it worked or not. After that I checked the tracking and it says Delivery attempted?
How is it possible they knew it did not work if tracking says they have not even got it yet? Is it possible the logistics company messed up with the tracking? According to the buyer, they chased the postman as soon as they saw the card they left and ran out to them to get their parcel. Could've the postman messed up with the tracking? Can I use this as an excuse not to refund or is it not much?

What does it matter really if they have the item?.
NO you cant use it as an excuse not to refund.
If they claim not as described then they need to open a dispute and when they do you send a pre paid label for them to return the item.
Once you have it back then you refund in full through the dispute.

Makes no difference really as if they open a dispute then ebay will almost certainly go with the buyer and you have to refund
Make sure the buyer opens a not as described dispute and you refund that way to make sure you get your fees back and it is done properly.
It does happen sometimes that tracking does not say Delivered and it may be as you say postman's error or the system slow to upload.
If it only says Attempted delivery and they opened a not received dispute then they would have won that dispute if the item does not show Delivered so either way you would have to refund
Attempted delivery does not count as delivered for an item you are sending to a buyer it has to say Delivered
The tracking counts as it has to say Delivered if the buyer opened a not received dispute.
but your buyer is being honest in the sense they are not claiming not delivered.
They say they have their item and it is not as described.
No matter which way you want to look at it they would win either dispute.
Really it is just splitting hairs as to which way you could get out of refunding.
Whatever the words on the dispute Not working Not as described they will win the dispute and you need to deal with it.
You say yourself you did not check the item. You were seilling for your brother.
You would expect them to work unless you listed as spares or repairs
