Can someone confirm when they have stated "starting January 1st 2024" they will being to share all data with HMRC does that mean that all sales starting from Jan 1st 2024 will be shared in the new format? I know historically that they have shared data but is this new rule in relation to all sales from 1st Jan 24 or everything historically?
I'm not a master criminal or a huge fraudster I literally sell £200 - £300 a month on here so think I may be over this limit and fear a taxman letter.

It was in the press a couple of weeks ago. 5,000 new officers over 5 years, plus 2,000 of something else (sorry can't remember what they were for).
I just know HMRC are very serious about closing out as much unpaid tax as possible.
I think the article said it was worth upto £40bil a year including fraudulent benefits and money laundering. So you can see why they are investing in it.

I read an article about that. The new government are keen to collect the unpaid tax and reduce benefit fraud so have bumped up the number of HMRC staff.

@jacross-81 Facebook market, along with all other digital market places from Airbnb through to Uber also have to provide the same information. No escape there.

not true in the slightest as sales are not even tracked or logged there is no information any wear on my facebook market account stating what has been sold especially when u can just delete a listing lol

The regulations now stipulate the new rules will require platforms such as eBay, Facebook Marketplace, Airbnb etc. to share the details of their users with HMRC as part of their general affairs.
HMRC have already posted messages on Facebook regarding this change however it seems many users chose not to read them or simply ignore them. Facebook are not going to put themselves in a position that leaves them open to sanctions by HMRC.
To clarify:
There is no new tax rules; they are existing rules.
These changes won’t affect individual sellers who are decluttering or selling their unwanted items. You only have to declare revenue from trade. Sellers should consider if what they’re selling fits with HMRC ‘badges of trade’.
When a seller purchases or makes items specifically to sell they can earn up to £1,000 before they have to register as self-employed and complete a self assessment. Once they earn even just a penny over the threshold, they are required to declare the income to HMRC as it may be taxable.
Personal tax allowance can be used against this income, but it just ensures all taxes are paid ensuring everyone pays their relevant taxes, the government hopefully won’t need to raise taxes for everyone else.

Well, they certainly aren't doing very much to deal with this yet - and we are already in October.
I occasionally put larger, or breakable items I don't want to pack on FB. When I delete the listing, be it sold or not, a pop-up appears asking if I sold it on FB/elsewhere/didn't sell/rather not say. I usually just close the pop-up. No nefarious reason, it's just the quickest way out of it. So FB have no idea what I have sold on there this year - and neither have I come to that, as I don't keep a record.

All platforms are dragging their feet on this at the moment as they realise this is going to drive sellers away for a number of reasons. At least eBay have started the process in asking for NINOs from some sellers with Vinted Pro asking for this on registration. Expect to see very busy boards on all platforms when the Christmas rush is over.
Most platforms already have the reporting means already in place, the NINO being the final piece in the jigsaw. Refusing the NINO to a platform will not prevent HMRC following through if they need to or want to as your other details which are provided gives them the links they require to receive information from your bank. This would delay the process but not necessarily prevent it. One way around this to only sell cash on collection.
Why not just ask Facebook what information they will be providing; HMRC have already stated that they will be requiring information from them. All platforms have to provide a copy to the seller of any information submitted to HMRC, but then of course it may be too late.

Whilst you are deleting the record, I think Facebook must still have it. Otherwise the marketplace could be full of stolen or illegal (dangerous) goods?
Pretty sure as an online platform there has to be some level of traceability?

Precisely, it's not in their interest to discourage early and reporting isn't required until January when HMRC will be chasing it.
Trouble is HMRC are gonna get one hell of a lot of data all at once come the New Year.
Good luck sifting through that lot, AI assisted or not!

I'm sure they may still have it - but how do they know whether it was sold or not?

It isn't to be done manually, but by HMRC's Connect software which was introduced some years ago and has been providing useful results (and savings) since. It can provide a wealth of information on an individual in seconds; it used to take days previously. It is used to scour vast databanks of personal and commercial information, seeking to unearth links between individual taxpayers and businesses, income, assets and transactions.
Connect can gather information from bank records, savings, pensions, tax documents, social media, activity on online platforms, DVLA, benefits, credit and debit cards, and more all at the same time. The good news is that an investigation only takes place after human involvement.
In short it means it is going to become ever more difficult to avoid paying due tax and it means identification of non-compliance is going to become ever more accurate.

I wonder if this is why there are so many 'free' listings on FB where they are not actually free and you have to message the seller for a price?
In many cases these are also clearly businesses, for example with a dozen new beds listed. I was looking for one for my son and getting very irritated with the underhand tactics.

I think that is probably just to catch people seeing 'free'. When those garden egg chairs were a thing, Marketplace was full of new ones either 'free' or dirt cheap. I always assumed they were scams, rather than businesses trying to keep under the radar. They used to say they were local to my area, but when you clicked the profile they weren't even in this country.

Did you see that business sellers had their NINOS published under their business contact details in full public view?
That was a spectacular mess up.

You can still sell more than 30 items its just the point at wich you will get automaticly passed on to HMRC.
