'No returns' only applies to change of mind returns. 

 

You have received an item not as described so you are guaranteed a full refund under eBay's Money Back Guarantee provided you claim within 30 days of delivery.  

 

You need to find the item in your Purchase History select 'More Actions' and then 'Return this item' selecting 'Item Does Not Match Description' as the reason. 

The seller cannot refuse an 'Item not as described' dispute and will have 3 business days to either provide a pre-paid tracked return label or a refund.  If they don't then you need to escalate to eBay the day after (as this weekend is a Bank Holiday the option to escalate won't appear until Friday at the earliest) or within 21 days of the dispute being opened and eBay will step in and force the refund.

If the seller requires the item back first then they will need to provide a refund within 2 days of delivery or attempted delivery.  If they don't then again escalate to eBay. 

 

Don't close the dispute for any reason until you have your refund.  Once you do have your refund make sure you leave appropriate feedback but remember to keep it polite, factual, and to the point.

In addition to the advice that @sml192 has already given you, if you do end up having to ask eBay to step in and force the refund don't mention this in your feedback, as if you do then the seller would be able to ask eBay to remove the feedback on the basis that it breaches eBay policy, as you are not allowed to mention in feedback that you had to escalate the matter to eBay in order to secure a refund, even if you are telling the truth.  In the event that the seller did end up contacting eBay and asked for the feedback to be removed for those reasons then eBay would more than likely side with the seller and remove it.  Therefore avoid mentioning anything whatsoever about having to open an eBay case.

What you need to do regarding ebay has been well covered by sml192 and there is nothing to add however if you want to report the counterfeit item normally it has to be reported direct to the rights holder.

 

In this case Sony are registered with VERO on ebay and they have their own page which most rights holders attach a report form - Sony unfortunately do not seem to have included their contact details or reporting procedure - it may be a case of searching google for it - reporting to VERO has to come from the rights holder to be effective.

 

If you can and want to report the listing and you can track down the reporting process for Sony -

 

if they react the listing will be swiftly removed - Vero reports are taken very seriously and the action is very quick.

Top tip: If you see a seller with 9 brand new Sony top dollar headphones for sale and they are not trading on a business account clearly they are up to no good.

Just to clarify ebay's stance on removing listings due to copyright  issues - this snippet from ebays listing removal policy frequently asked questions :  

 

Why was my listing removed/hidden when similar listings are still active?

 

A participant in the VeRO Program may have asked us to remove your listing but hasn't requested the other listing be taken down. These types of removals are only done at the request of the VeRO participant, and aren't eBay's decision. Read more about the VeRO Program

 

Under the counterfeit item policy it states :

 

Counterfeit products are illegal and not allowed on eBay. These items may infringe on someone’s copyright or trademark.

 

Activity on eBay is required to follow this policy, the eBay User Agreement and all applicable laws, as well as respect the rights of third parties. If it doesn’t, eBay may take action consistent with applicable laws and the eBay User Agreement, and may even be legally required to do so. Such actions may include, as an example only: Removing the listing or other content, issuing a warning, restricting activity or account suspension.

I just purchased a pair of Sony wf-1000xm5 earbuds.  Arrived today and they are really awful sounding fakes. I have asked for a return.  I noticed that the listing had been removed not long after the purchase, due to breaking ebay policy.  The seller is in China but was shipper from Buckinghamshire.  I'm worried that they'll be problems getting a refund if the seller is no longer on ebay. 

How was your experience? Did you get a refund? Any advice?

If the seller has been removed,  and only eBay can do this if the seller has recent transactions, then you'll need to contact eBay Customer Services for them to open a case for you,  for your refund.

 

This is the easiest and quicket way to contact eBay Customer Services, for a Call Back option.

Lines open between 8 a.m. to 10 p.m. on weekdays.

9 a.m. to 6 p.m. on weekends.

 

I recommend contacting CS very first thing in the morning, when the lines first open,  as there's more chance of Dublin answering.
