refund not being paid

Hi Folks ,

 

first time using this forum ans near impossible to contact ebay

 

in a nut shell i purchased a lawnmower last December from a seller  who advised it was as new and in all working order

 

I was having my garden landscaped and obviously i did not need a lawnmower in december but wanted one for spring ready for my new lawn to be cut- when i went to use the mower in march it was not working and some parts were missing - i contacted the seller, and he has offrered to refund me but he says he cant , he has tried everything to avoid refunding me .. i contacted paypal and they refused my claim as it was over 3 months ... i am about to take the seller to the small claims court , but i just wanted to ask if i had any other alternatives ... seller will not reply to any of my messages .. and i think its morally wrong that he has taken my money and not offered to repair or replace it ... what should i do ? basically accept i have lost my money .. surely that cannot be right ? thanks in advance

You cannot report this to eBay as they do not offer warranties or guarantees on items, just that they are just as described on receipt.  If they are not,  a buyer has 30 days under eBay's 30 day MBG,  Money Back Guarantee policy,  to return the item for a full refund.

 

If you bought this from a Private seller you are too late to claim a refund.  Not sure if your payment provider would help with a refund seeing you had the item for 4 months and purchased second hand ?  Worth a shot,  nothing to lose.

 

If purchased from a registered UK business, who offered a guarantee and is now not upholding this,  then turn to Citizens Advice for your next steps,  if you wish to take this further.
