item developed a fault under 1 year guarantee

Seller failed to respond to my 1st 2 messages. In my 3rd message I reminded him that, under ebay rules, he was obliged to respond to me within 2 days - he answered immediately! It took a few days for seller to admit he'd received phone and I gave him a deadline of 26th Nov to repair or replace my phone. I sent another message asking him if he'd done this but no reply!

You haven't said if you are still within 30 days of the item's last estimated date for delivery.  If this has lapsed,  then you cannot report this to eBay as they do not offer warranties or guarantees on items, just that they are just as described on receipt.  If they are not,  a buyer has 30 days under eBay's 30 day MBG,  Money Back Guarantee policy,  to return the item for a full refund.

 

If you bought this from a Private seller you are too late to claim a refund.  You could try your payment provider for help with your refund.

 

If purchased from a registered UK business, who offered a guarantee and is now not upholding this,  then turn to Citizens Advice for your next steps,  if you wish to take this further.

When you have a problem, ebay only deal with cases opened within 30 days of receipt. Once outside that time there is nothing can be done through ebay.

 

NEVER accept replacement or repair as settlement, you only get one chance to open a case, and replacement or repair, if still faulty gives no opportunity for a second attempt to get a refund.

 

Always use a proper ebay case and get a refund, then if still confident in seller buy again.
