eBay shops and private sellers

Could one of our knowledgeable mentors kindly clarify eBay's rules/position/expectations regarding private sellers, business sellers, and eBay shops? 

 

Today I came across a private seller who has an eBay shop. I thought that if you have an eBay shop then you are automatically a business seller. Or have I misunderstood things?

It's one of Ebay's unexplainable decisions that private accounts can subscribe to a shop.

 

Personally I think that's ridiculous.

 

Some businesses seem to think that having a shop is what registering as a business on ebay is, so it's also leading to misunderstandings.

So if this "private" seller is buying things to sell on (and I know this to be so because there are items in their shop that they bought from me!) should one take any action? If so, then what action?

 

I have no objection to people buying stuff from me to sell on - after all, I got the price I wanted for the items  - but think it's a bit off to do so and still claim to be a private seller.
