I recently bought a vibrator through this site. I paid for a new vibrator and the product was received in an open bag and was probably previously used and returned. Ebay closed the case and I received neither a new vibrator nor a refund. So I wanted to ask where are my rights as a consumer?

If you open[ed] an eBay case for not as described [used not new] you can escalate it on day 4 to eBay to deal with.

Thank you for your reply. Unfortunately, the only option I see here is 'send an appeal.'

As long as you are within 30 days of delivery you have to go to the item in your purchase history, open a return using "Does not match photos or description"
Your seller will get 3 working days to either send a return label and pay for you to return it, or will refund you without return.
If they do neither you should escalate on the 4th day and ask ebay to step in.

If you opened JUST A RETURN CASE which would be treated as a change of mind, and you bought from a private seller then case closes. Business sellers have to accept returns for any reason.
OR did you open a case and then do nothing so that it just timed out?
You only get one chance with ebay, so try your payment provider.
