Seller has scammed me

Seller has scammed me by sending a fake tracking number. He also has zero reviews on his profile and has tried to sell me an iPhone 16 pro max new for £500. I put in an “item not arrived” case with eBay but they haven’t done anything about it and just keep putting my case on hold and extending the date and delaying my refund. The scammer is trying to delay it until 30 days have passed so that I lose my buyer protection and then he will probably try to send me a fake phone or no phone.
