SELLER REFUSING TO HONOUR A REPLACEMENT UNIT - I'M NOT ASKING FOR A REFUND.

Good afternoon folks,

I've just found this site after being given a royal runaround by a seller. I won't bore you with details of 38 pages of correspondence (lots of photos and bluster sadly) - so I hope you'll forgive me if I just list bullet points.  - not being rude but here goes:

  • I bought a circa £300 12.3 inch screen unit for my BMW at the end of Ocgtober last year  I got in touch pretty swiftly as I'd had problems with the unit - I even emailed them to say I was concerned about the "drop-off date" potentially compromising my purchase.
  • No bother says they - we will sort out all the issues and if that ultimately means a replacement unit, that will be fine.
  • Over the following months, I was content to take them at their word, in the knowledge that a replacement unit would be the solution.
  • On 18 February the Sellersd emailed at 09:08 saying “Hi XXX, Thank you for your patience and for providing the videos and photos. To proceed with the replacement, could you please share the specific issues you've been experiencing with the unit? This will help us ensure a smooth resolution. Looking forward to your response. Best regards.‌‍‍‍‌‌‍‍‌‍‍‍‍‌‌‌‍‌‍‌‍‍‌‍‍‍‍‍‌‍‌‌‌‌‌‍‌‌‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‌”
  • I was literally gobsmacked; as all they had to do was follow the long thread of correspondence. Nevertheless, I forwarded a comprehensive email outlining (again) what the issues were/still are.
  • Since then - radio silence - they've refused to engage, and they've ignored plaintive emails reminding them of their repeated assurances of a replacement unit.
  • So, I'm left in limbo with a non operational, useless £300 piece of kit - and Ebay online can't help because of a 90 day limit?? 
  • Can anyone advise of a route to resolution please?

Ebay MBG is only 30 days, so they won't help now.

If it was UK business, contact citizens advice for help.

If it's a pity that you to chose to negotiate with the seller yourself instead of using eBay's money back guarantee. You had 30 days (not 90 days!) to open a case and the seller would even have been required to send a repaid return label. However, there is no right to insist on a replacement, only to get a refund.

 

As you tried to handle it yourself I'm afraid it's too late now to ask eBay to help now. After their 30 day time limit has expired it's entirely between you and the seller.

 

This doesn't affect any statutory consumer rights you may have, best to ask advice from a solicitor or Citizens Advice.

 

Before doing this, if you paid by credit or debit card try contacting your card issuer. Depending upon the circumstances they may be able to help. Good luck!
