Item returned after 3 delivery atemtps on the tracking history.

Also it has been damaged and ripped open and missing a item and returned to me in the condition in the picture.

Where do I go from here asni cannot find my problem listed.

If buyer opens item not received case, they will lose as ebay accepts attempted delivery as proof of delivery. 

So you won't have to refund buyer, which means you haven't lost any money.
