Item not received

Hi, hope someone can help me. 

I paid for a pre sale pokemon item and have not received the item. I messaged the seller and they said they was still waiting to receive it themselves and would update me once they had received it.

This item has now passed the 30 day ebay money back guarantee and I cannot log for a refund on ebay. Can anyone suggest best next steps please

Presale items have to be despatched within 40 days of purchase, if you are out of time for an eBay claim you can try your payment provider Paypal/Bank card etc for an item not received claim.
