What do I do when a business seller is using my address as their returns address and part of my husbands name as their user name.  
this is fraud surely but despite easing this with eBay they are saying the person is doing nothing wrong!

This is a surprisingly common issue.

I remember watching a TV programme, several years ago now, where a whole street in one UK town had foreign businesses registeered at almost every house.  Most of the home owners were completely unaware.

You can report the business to Companies House.
