Buyer refunded but kept items

Need help please.

so long story short, I sold a bundle of teddys for £1000 the buyer received the item but said some had stains/marked so wanted a refund however these marks was mentioned in the description. The buyer then went straight to PayPal for the dispute to which they won and the funds taken out my account before I received my items back and now the seller isn’t responding and eBay saids that they have no control and to speak to PayPal. I phone PayPal and because my name wasn’t on the dispute I wasn’t able to speak about it.

It has now been a month and I’ve just seen the buyer selling my items via eBay and Vinted.

anyone know what I can do? other than speak to eBay or PayPal as they are just paring me off to each other.

Oh dear, this is awful.   Usually best to accept returns even if the buyer is trying it on.   

 

You won't get anywhere with ebay or Paypal.    You could try money claim online (previously small claims court):

You could tell the buyer that's what you intend doing.   It might prompt them to do the right thing.

If the buyer opened a case with Paypal and didn't try to open a return through Ebay, then Ebay are just not involved with this dispute.

Generally, Paypal do ask buyers to return items but this does require the seller to be cooperative and provide an address.

Others may have better advice, but I can't think of anything you can do in this situation.

Certainly, Ebay will not take any action.

Yes it is awful, you must be gutted.

 

I wonder why your buyer went straight to Paypal instead of ebay? It makes you wonder if they have opened too many ebay cases and are now banned from opening any more.

 

I believe there is a "letter before action" which you can Google. You should send this to your buyer before you do anything. This may jolt your buyer into doing the right thing before you take further action (If you still intend to do).

 

Take screen shots of all the teddies etc they have listed and create a folder to use as proof. The best of luck.
