What Can I do if a seller was promise and promise a new Item , but It never arrived,

Hi Guys!

I have an issue with a seller, I ordered an item what  ins`t working well, The seller has promised a newone, but it never arrived. Now when I am sending him a message he is replying only with automessages....
Unfortunately I was ordering from him in April, so I cant get a refound automaticlly with eBay .

Anyone can help me What should I do?

You are out of time for ebay to help you.  If you paid through PayPal you can still open a paypal case though.
