Returned item, item not delivered in limbo!

Bit of a predicament here as I cant seem to advance the situation.

1)  I bought several items from a seller
2) Items are faulty - contacted seller who denied liability but I started refund procedure

3) Automated Ebay issued postage label provided (48 hour return)

4) Item swas posted back via post office

5) Tracking shows iutem was attempted delivery and card was left 

6) Now, as a buyer I'm in limbo as the seller seems to be avoiding accepting the return  as I cannot have a refund until he has accepted receipt as tracking indicates.

I cannot ask Ebay to step in as there is no option allowing that to happen? What do I do now?

Attempted delivery is all that needs to be showing for a refund, you should get the option to escalate to eBay 3-4 days after attempted delivery,keep checking.
