Thank you for your update but I repeat my question. I am confused.
Have you actually opened a case in the resolution centre [link below]. It really does not matter what the seller might have promised.
If you have opened a case then you "escalate" it after 3 business days. EBay then steps in and refunds.

You open the case, the seller sends the label with tracking and refunds in full when it arrives back
Where are we in that?
Do NOT get replacement, get refund.
Escalate case to ebay to sort refund.
