Return damaged item

I have opened a return for a damaged brand new motorcycle i bought for my daughters birthday, the return is open but when I try to request returns details it says the return is closed? The return was only started 48hrs or so ago please help.

As a last resort contact trading standards via CAB as the seller is a business seller trading as a private seller in violation of eBay rules and the law.

Thank you for your advise i will contact cab. Im getting mixed replies about the return being a motorbike saying i cant because its a motor vehicle? But its a brand new faulty/damaged motorbike so surely being faulty damaged goods i have the right to return it?.

vehicles of any kind are excluded from buyer protection by eBay and PayPal. Looking at your sellers listings clearly shows they are a business seller trading illegally .

Although this miniature dirt bike was sold under "sporting goods" the listing does NOT carry the logo for eBay's money back guarantee.

I imagine that eBay classes it as a motor vehicle, in which case it is excluded from any buyer protection. Even if this applied, as you first opened a return request you would not have been able to open a money back guarantee case anyway, as eBay only allows one case to be opened.

As this was a private seller you have no statutory consumer right to return it either.

You could try filing a dispute under PayPal's buyer protection policy, but if they also class this as a motor vehicle it will be excluded from this too.

If you mean a REAL motor cycle, then you should have read that Vehicles of any description are not subject to the Money Back Guarantee. As a case cannot be opened it would automatically close.

Buyer is expected to inspect and see all the Paperwork before paying.
