Have you been refunded? Has he cancelled the sale?
If the answer to both is no, wait until the very last estimated delivery day has passed and open a Not Received dispute n the Resolution Centre.
Leave appropriate feedback but do not use words like ebay, refund, dispute or case as that can get your feedback removed. Just say something like "Seller refused to sell item I won".
