Paid for item I will be collecting

A seller accepted a 'best offer' and I immediately paid for the item via Paypal. Couple of days have passed since I made the payment. I requested the collection address to which the seller said they will wait for the balance to clear in their account and then sort out collection; fair enough. As I understand it, Paypal payments are immediate but sometimes Paypal can hold the money for a certain time. However, given I have paid, which is something the seller can identify at their end, are they not obliged to give me collection details for me to arrange collection in the near future? 3 days have passed since I paid and sellers communication is pretty poor.

The seller would have been wiser to ask for cash on collection, and you could have gone and inspected it and only paid if the item was what you were expecting. 

However now that you have paid you are entitled to take possession of it.

You cannot do anything until a week has passed, and if then, your seller still hasn't been in touch, you can open a not received case in the Resolution Centre to get your money back.

Thank you for your response. Only reason I have paid is due to me being out of the country so am getting someone to collect for me. Yes I am sure it will be okay but as you said, I will wait for a week at which point I will open a case. Thanks again.

The seller has replied to me but even though the money cleared into his account on 30th, he has still not provided his address saying due to 'other commitments' pickup may be next week. Regardless of commitments, he now has my money (in hindsight should have paid on collection) so I have just sent him a cancellation request and tomorrow will be able to open a 'not received' case. I am now at the point that I want to cancel whether he provides his address or not. Is what I have done the way to go i.e. request refund from him and open up a 'not received' case? Do I have enough of a case to get a refund regardless of him providing me with his address or his 'no returns' policy.

If he accepts your cancellation request he should also refund your money. This could take a bit of time to get back into your account as you would have to wait for the payment to clear into his account, and then it would have to be returned to your account. If you funded your payment with a debit card it would take about a week, if a credit card it could take up to a month. You would be unable to open a not received case as it is either a cancellation or a not received case, you can't do both.

The Seller has 3 days to Accept your Cancellation Request. Your Refund is then automatic. You should Receive it practically straight away. You don't have to wait for any Payment to Clear into your Bank.
