Item already sold privately

I bought an item and paid immediately with PayPal as I always do. 5 hours later a message arrived from the seller to say item had been sold privately and they probably should have taken it down.

So I asked for a refund. 

Seller disputed payment, then moved to I shouldn't have paid when it wasn't available. I pointed out it was available on ebay at the time.

Seller says they won't receive funds for 4 weeks from date of purchase so I'll have to wait and he doesn't care if I have to wait. 

Value is under £25

Open item not received case 1 day after estimated delivery date, escalate after 3 working days,

ignore seller excuses.
