Compensation restrictions and offers to purchase enhanced compensation.

I recently had a problem with delivery of an item for which I had purchased a postage label through Shutl.  The problem was eventually sorted and I have my item back so I won't go on about that but it highlighted a possible serious issue (IMO) with the postage label service.  I have reported it to Shutl but can find a way to get it to the attention of ebay except via this means.  I am wondering if anyone else has any views....

 

  • The item concerned was a Lens for an SLR camera.  It was listed in ebay category  “Cameras & Photography > Lenses & Filters > Lenses”
  • When I purchased the postage label through ebay I was offered enhanced compensation (which I accepted).
  • The item was reported as not delivered by my Buyer and the tracking information was decidedly unhelpful (I did eventually got some good help from Shutl – good on them).
  • While in limbo with goods that were undelivered and possibly lost in transit, I put in a claim, and also took a long look at the Shutl T&Cs.  I found a significant list if items that would not qualify for compensation. This included items made of or incorporating glass (I can’t remember the exact wording) and therefore Shutl may not have paid compensation anyhow.
  • This detail is hidden away in the T&Cs and is not easy to find (took me about 30 mins and I was looking) and will be missed by most purchasers of postage labels leading them to select an inappropriate courier and/or pay for ‘insurance’ which will never be honoured.
  • Because of the classification of goods, ebay/shutl ought to know it should not be offering enhanced compensation for some categories of goods and I would argue it should also be making customers aware that even standard compensation will not be provided for certain categories of item.
  • Fortunately my lost lens has been returned but if it had not been returned and I was told I would not qualify for compensation having been offered it incorrectly – I for one would be in the small claims court/talking to the FCA arguing improper selling of financial products.

 

 

Has anyone else had an issue with being refused compensation after explicitly being offered insurance and paying for it.
