Brand name used to sell random item

I hope somebody can help me. I have just been cheated out of some money. I purchased a dress from EBay under brand Maje. Just received the dress and it’s some random cheep item. Contacted the seller and she refused me the refund saying it was advertised as Maje style dress. In pictures advertised the label is turn upside down so its not visible that the dress is fake. I particularly wanted to buy this dress as I recognise the style from collection few years ago, what turn out to be cheep copy. My question is are the sellers allowed to do this, to sell a random item under brands name and how do I proceed and get help from EBay? I don’t see how can I open a case with EBay if the return haven’t been accepted by seller and seems closed? Many Thanks

Did you open a returns request as if you did and it was refused then you can not open a not as described dispute

You can only open one dispute on ebay

Your item is not as described

Open a not as described dispute at the bottom of the page under Resolution Centre.

Escalate it after a full 3 days of opening the dispute.

The seller needs to send a pre paid label for the return.

If they dont then ebay should when you escalate the dispute.

Make sure it goes back tracked and that the tracking is in the dispute.

You have 30 days from the day of delivery to open a dispute in ebay

Open an appropriate 'Not as described' eBay case for a refund in full ? ... messages will not do it ! ... follow the case instructions carefully and you should  receive a prepaid addressed return label, enter tracking and escalate the case to eBay when allowed to do so (usually 3 > 8 days) ... the within 30 day case options which a seller cannot ignore are here >
