Return stuck at 'Out for Delivery'

A big seller of 2nd Hand DVDs sent me a DVD which should have been replaced under the BBC's replacement disc scheme, but wasn't. You could argue not sellers fault, but you could also argue what's the point of owning a TV series on DVD with a random 4 minutes deleted from the middle of a key episode. (Of course it is also far too late to exchange the disc officially via BBC Worldwide / 2Entertain or whoever owns who now).

I returned it RM Tracked Returns as an eBay provided label but it's been stuck at 'Out for delivery' for 9 days. Suspect as the seller must gets tens if not hundreds of returns a day, I'm the unlucky one that's missed the scan...

Real world, do I just need to escalate as soon as this is offered to me? For returns is tracked entry into the postal system deemed as delivery? Or should I make investigations with RM? The seller is notorious for never giving refunds until you claim ANYWAY so don't want to do this wrong. That said, its a £5 disc... Cheers!

Ebay won't force the seller to refund until the tracking updates and shows delivery so you will just have to be patient.  You can't escalate until 48 hours after the tracking shows delivery back to the seller.  'Out for delivery' is not delivered.  You could ring RM for an update if you have an hour or so to spend on the phone.  (In fairness, they are always really helpful when you do get to speak to them - you just have to not lose the will to live while you listen to that awful music ...)

Couriers seem to be struggling with deliveries already and it's only 8th December!

I'll be honest in my experience if it fails at 'out for delivery today' it is not good unless it was end-of-shift or buried in a dark van then actually delivered the next day when it gets spotted under the lights, happens here a lot - in fact it happened to me yesterday.

Suspect they DO have it bundled in with a delivery of 100s of others and it will never be tracked. i.e it is likely delivered but I will never be able to prove it 😞

As this is after all, RMs kokup, I've put a claim in. They can only say no. Easier to deal with than ebay.

Update - it never did show as delivered, but to my amazement (given previous dealings with slowness at refunds even when tracking HAS been there) the seller has agreed to a refund. Didn't say they had it, just that they'd refund anyway. Will cancel the RM claim the minute I see the money, which isn't yet....

True to their history the promised refund never came.

Escalated to eBay, instant refund. Clearly posted and out for delivery was good enough.
