Fake tracking number / Fake delivery scam. Using courier TNT

A seller is trying to scam me out of £475.

And right now it looks like they're going to succeed.

 

Maybe someone has some advice on what to do?

 

Sequence of events:

-I bought and paid for an item. £475 total value including next day delivery.

-Around 3 days later the seller added a TNT tracking number saying the item had been delivered.

(But no item has been delivered to this address).

-I opened an item not received case asking the seller for the info I needed to view the Proof of Postage to see where it was delivered, who signed for it, etc. 

-No reply from seller other than to add the tracking number they'd already given me.

-A few days later I asked ebay to step in,

-Ebay decided the case in the seller's favor, because the tracking said "delivered".

-I contacted TNT to see what info they could give me. Due to data protection / privacy policies they couldn't provide any extra information about this shipment beyond what is publickly available on the tracking page. The only thing they could confirm was that it was NOT addressed to me, and not delivered to me. (my address did not match the address associated with this shipment/tracking number.

-I appealed the ebay decision explaining the situation.

-ebay asks me to:  "get back to the shipping company one more time and clarify with them that:  

○ All you just need an email or letter which states item was lost or delivered to a wrong address and let them know that you have no intention to file a claim.

○ If the letter or email confirms about this tracking being lost or delivered to a wrong address, then it will be enough for us to issue a full refund. Here is the link to upload a letter or email copy:  ... "

-I go back to TNT and paste in this exact section. TNT repeats that they cannot give me any further info about the details of this shipment and cannot provide what ebay is asking me to get. This is because, from TNT's perspective, I'm not connected to this shipment in any way, because it was never addressed to me.

 

My so latest effort has been going back and forth between ebay and TNT (the courier used), but nothing is working. Ebay is telling me to go back to TNT to provide documents to prove that it wasn't delivered to my address. TNT says they can't do that, and they're telling me to go back to Ebay or involve the police.

 

My last communication from each are:

Unfortunately we cannot do any more than advise to contact the sender or contact the police if a scam has occured.

TNT have delivered this to the address we was provided by the seller.

There is nothing for TNT to investigate as TNT have delivered it to the address we were given to deliver this to.

The investigation needs to be the seller which we cannot investigate. This is a police matter or eBay matter to investigate,

I totally understand your frustration but we cannot do anymore due to data protection laws.
 
And from ebay Ebay:

• I understand you have not received the item and you believe the seller has sent the item to a different address other than yours.

• I appreciate you for contacting the selelr (sic) but, they are not responding to your messages. Please be assured, I'll assist you further to get this sort.

 

I would have happily acquired this information for you, but we cannot contact a courier service on behalf of a recipient due to EU Data Protection Laws. We ask buyers to investigate with the courier company just because as a customer you have a right to know where the item is and to get the investigation outcome. If sellers are supposed to contact they are liable to have the compensation from the shipping company, however we want to protect you as you are the one out of pocket and we do not want you to be such if it is not your fault if the item is mis delivered or lost in transit.

 

Hence, I would urge you to get back to the shipping company one more time and clarify to them that you have no intentions to file a claim. All you are requesting is an investigation to be completed to find out “where” did they deliver your item. If the investigation confirms that the item was lost or delivered to the wrong/different address, then the courier's customer service will send you an email or a letter with their findings which need to be provided to us as proof. The moment you write back (and also attach the document) in your email, we will validate the details and promptly initiate.

 

I know this is a bit of an extra effort, but I really don't want you to be out of pocket for this transaction. I would have loved to contact the shipping company on your behalf, but EU General Data Protection Regulation does not allow us to do so.

 

Furthermore, I can see my colleague has already addressed this concern for you. If you have any new information or additional questions for us, I'd be happy to help you. For now, we can take no further action and consider this matter closed until we receive requested documentation.

Is it not possible for a human at ebay to just get confirmation from TNT that this shipment was never addressed to me? Seems like that should be simple?

What information does the tracking actually show?  It should state the postcode/house no. that the item was delivered to along with the GPS coordinates.

 

Given the value involved I would report it to Action Fraud/Police as eBay suggest.  They won't investigate anything but it will add weight to any claim.

 

If you are not able to obtain a refund through eBay then contact your payment provider (PayPal or Card issuer) for assistance.

When you enter the tracking number through the TNT tracking page it only shows the journey of the package and that a Delivery has taken place.

It doesn't reveal the actual delivery address, gps coordinates, who signed for it, or picture of delivery. 

 

The only way to view more info or to see 'Proof of Postage' is by providing one of the following:

sender's TNT customer number

sender's email address

OR a phone number associated with the booking.  

I have none of this information.

 

I've asked TNT for help providing what ebay is asking me for, but they are bound by privacy policies and cannot provide personal details for this shipment. This is because from TNT's perspective I am a 3rd party. I'm not the sender and I'm not the receiver.

 

The one crucial piece of info that TNT was able to provide to me was confirmation that this shipment was NOT addressed to me.  You'd think this would be all I need, but I don't have any way to transmit this information to ebay in a form that they will accept. 

 

I've copied and pasted them the transcripts of my conversations with TNT, and ebay are still asking for a letter or email from TNT saying they've concluded an investigation that shows the item has been lost or delivered to the wrong address.  But what ebay doesn't seem to be able to understand is that from the scammer's perspective and from TNT's perspective the tracking shows delivery to the correct address, but it wasn't my address.

 

Pretty clever scam.

 

 

I don't want to have to involve the police, but maybe it's my only option?

Regardless of the outcome I don't think I can trust buying anything expensive on ebay again after this, unless I know it's been fixed.

This is a massive loophole, and ebay's support has been terrible.

All your had to do was give TNT your address and ask them to confirm in writing that the address on the package with that tracking was not your address.

 

They didn't have to give you information about where it went, just that it didn't go to you.

Do as advised by @papso22 and then, if eBay still won't refund you, if you paid with a debit or credit card issue a not received chargeback.

I doubt they'll send me it in writing, but that's what I'll ask for.
