Counterfeit item received after opening not received case

I opened a not recieved case. The item has now arrived but it is counterfiet. The seller has agreed to refund if I return the item. Should I close the not recieved case ? Will this then allow me to open a return case ? I want to do the return through ebay so that I can ensure that I get my refiund.

If the item is delivered [with tracking] then the seller can close the non-receipt case and you can open a SNAD case. 

If you close the NR case you can open a SNAD case - it's the only time you can open two

If you have not closed the case yet then don't do anything with it for the moment.  Instead contact eBay about the matter and explain to them what you've just told us, and ask them if there's any way that the Item Not Received case could be changed to an Item Not As Described case given that you've received something from the seller now but the item received does not match the item that you had paid for.

In case you are not familiar with how to contact eBay Customer Service click on the Help & Contact link that appears both at the top and the bottom of this page.  When the next page loads up scroll right down to the bottom of the page and click on the mobile phone icon that appears beneath the words "Need more help?  Have us call you."  You should receive a phone call from eBay, at which point you can explain what has happened and ask them to switch the Item Not Received case to an Item Not As Described case.  However, if you just try to do it yourself and end up closing the Item Not Received case then you will not be able to open another eBay case in relation to the same transaction, so don't close it yourself or you'll end up shooting yourself in the foot.

Not sure how you do it but you need to change the TYPE of claim to not as described from item not received.

If you close the case i don't think you can open another one but another bus full of better info will be along soon ....
