Question Re: Refusing a refund because measurements were provided in Selling on eBay DND

We can all see from the listing what was in the title and description..clearly states 18/20

You cannot fight a not as described case...if you let the buyer escalate to eBay, eBay will either send the buyer a prepaid returns label at your expense and plonk a defect on your account or, eBay will tell the buyer to keep the item and take refund from your account....

Hi there,

I sold a pair of jeans with the measurements (W32 L30) provided in both the title and description as well as pictures. I mentioned that the jeans are stretchy and can fit a size 18/20, but ultimately the measurements were there so it was up to the buyer to make a judgement on that.

The person i sold these jeans to is now asking for a refund because they don't fit her and she is claiming I falsely advertised the jeans because I suggested they could fit a size 18. However, the exact measurements are stated in the listing.

I feel that it is unfair to provide a refund (I also stated on the listing no refund or returns) especially when I have provided true measurements and accurate pictures.

I have asked her to open a case if she is unhappy.

Can anyone please provide me with some advice on what I should do or if there is anything I can do to fight this so I can prevent Ebay from refunding her?

Thank you in advance for your help.

Depends which Case she opens? You will be ok if she opens a Case stating "Does Not Fit" as Ebay Class that as a Change of Mind Return. As a Private Seller with a No Returns Policy you can Refuse.

However if they Open a Case stating "Item Does Not Match the Description, Faulty in some respect" then yes sorry you will have to accept the Return. Not all is lost, your Final Value Fees will be Refunded. You get the Jeans back. You can then Relist them at a higher price.

Thank you for your quick response.

She has asked for it to be returned as there is something wrong with the item. Am I able to refuse this based on the fact exact measurements were provided of the item?

If I do accept a return would i have to pay her P&P fees to receive them?

Thanks in advance

When she opens a Returns Case there isn't an option of "something wrong with them." It all depends which Case Option she selects ???

No good you trying to argue the Case referring to measurements. EBay do support the Buyer. Yes you will have to generate a Returns Label through the Case. As said you can Relist and ask more for the Jeans.

You stated fit size 18/20, so that is part of item description & ebay allow buyer to claim not as described.
Issue returns label through case & refund in FULL on return.
Ebay will charge you £3.25 for label.
If you think not worth paying to get item back, refund through case straight away, your choice.

But you also said that they would fit sizes 18-20, and there is no way on earth that a W32 will fit sizes 18-20, even with stretch...! So the jeans are definitely not as described. W32 will fit a size 14 - look up sizing for yourself by doing a simple web search.

So accept that you've messed up, apologise, tell the buyer to open a not as described case, and agree to refund on return. If you dig your heels in and refuse to refund on return, Ebay will force the refund without the need for return, as per their Money Back Guarantee (which you agreed to abide by when you registered your account). They will also slap a damaging defect on your account for not accepting the return and refunding voluntarily.

@tazk-123

Thank you for your reply.

I appreciate your comment, it's just disappointing that I listed the measurements W32L30 and made them very clear, so I would have assumed the buyer would have checked to make sure they would fit her before purchasing. Perhaps shouldn't have listed as fit a size 18/20, but they did fit me when I was that that size, hence selling now i've lost weight.

Hopefully I can resolve it with her.
