    <description>&lt;P&gt;Point out to ebay that tracking shows as delivered, and enter tracking into the opened case.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;There should be no question of refunding to a case where proof of delivery exists &amp;nbsp;and in any case well outside the 30 days allowed.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;Buyer may have started a chargeback through his payment provider with a longer time to claim, but proof of delivery must still be good enough, but this must be pointed out to ebay.&lt;/P&gt;</description>

      <description>&lt;P&gt;Just had email from ebay saying a buyer has raised a payment dispute looking to get back £300 for pair of Louboutin shoes I sold way back on 15 February saying that they never arrived.&amp;nbsp; &amp;nbsp; Tracking shows shoes were delivered and indeed the buyer left feedback.&amp;nbsp; &amp;nbsp; &amp;nbsp;Funny how this report goes in 90 days later.&amp;nbsp; &amp;nbsp; &amp;nbsp; So I have to issue refund and have lost shoes also?&amp;nbsp; &amp;nbsp; &amp;nbsp; Can I sue the buyer for fraud, what exactly will ebay do about the seller lies.&amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; The address was appleby in cumbria synonomous with a certain demograph of the popular.&amp;nbsp; &amp;nbsp; Definated been scammed.&amp;nbsp; &amp;nbsp; &amp;nbsp;Any advice what I can do?&amp;nbsp; &amp;nbsp;&lt;/P&gt;</description>

&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;If this is an eBay case opened,&amp;nbsp; it can be opened ,&amp;nbsp; but it cannot be escalated,&amp;nbsp; then it will just time out and close.&amp;nbsp; The time to claim with eBay r the buyer,&amp;nbsp; has expired.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;If this was a charge back from their payment provider,&amp;nbsp; that's a different matter.&amp;nbsp; They're in time for this claim.&lt;/P&gt;
