You should not have tried to clean it at all and opened the dispute straight away

You also should not have sent it too Trading Standards

Did you contact them first and ask about it as I would think they would only take action if it was a business which I am assuming it is not.

If you had not tried to clean it then the seller would have been made to pay the return postage and you would have received a full refund for not as described

Even if you lost on ebay then you could open the dispute in paypal and you would have received your money back

Now you have given it too Trading Standards then you would have nothing to return to the seller to get your money back

i bought a dress and the seller mentioned marks on the inside - no problem - however i got it and in total there were 23 marks which were stains like dried blood or faeces on the inside and outside - disgusting - it was also clearly stinking of having been worn - not a mouldy vintage smell nor smoke nor musty but that smell you get when something has been worn and been against flesh and not cleaned. i took a cotton bud and dampened it - firstly to see if the marks might come out and secondly to see if a tiny amount of water showed it as blood or not. Anyhow mark did not come out at all - so totally dried in - i opened a return case and got a load of abuse from the high feedback seller - then they went to ebay and said i had altered the condition of the dress and so wouldnt take it back - l lost the case and appealed and ebay also said i have altered the condition - which i havent as the stinking mark is still there lol - so im ripped off for about 35 pound and am so angry that ive posted the dress to the local trading standards office asking them to verify what the stains are and to report this business seller in their own area.

i am disgusted that anyone has sent out an unwashed item. is there anything else i can do to report this seller? i am sure they are churning out many sales and obviously got mainly good feedback but they got it wrong in this case and im the one left feeling annoyed because ebay took their side - unfairly imo - any suggestions? thanks

@indigo-phoenix

Unless the seller was a registered business seller in the UK then trading standards can do nothing....they can do nothing about private sellers

You should have followed the case & returned the goods immediately not attempting to clean

• If an item received is not as described the first thing you should do is contact the seller to try to resolve things simply
•
• In the event that requires a return of the item then you should open a not as described case here : http://resolutioncentre.ebay.co.uk/
•
• As long as the seller is UK based then they should issue you with a prepaid tracked label as part of the returns process.......use it, add the tracking number to the case & you should be refunded as soon as delivery is attempted
•
• If things do not go smoothly you can escalate the case when it has been open a full 8 days to request eBay to step in
•
• DO NOT CLOSE THE CASE UNTIL RESOLVED !! Do not believe sellers who say they cannot do anything while the case is open as once closed it cannot be reopened !!
•
• Do not pay to return the item yourself as eBay cannot force reimbursement of postage charges if you do !!

i did all of that and because i said that i used cotton bud to try to remove one of the marks ebay have agreed with seller that i have altered the condition - absolutely false as the stain is still there - there doesnt seem to be a place to actually report a seller only the item for policy violation and stinking clothes all stained and dirty doesnt seem to be covered - she is a business seller with high feedback

yes i was being honest lol - there were 23 marks - some of them the size of a 10pence piece and others like pin pricks - it was one of the smaller ones - on the lining - i just rubbed over the surface with a damp cotton bud

- i opened the case and make the mistake of saying i had done that. the seller has exploited this fact - its like buying something covered in dust and attempting to brush it off - admitting to doing this and saying marks still remain. i think the rule is ambiguous! the dress was not altered in any way as the mark didnt shift. so- the secret is if you get filthy things and try to work out if they will clean or not - dont! just complain? IF the marks had come out i would have been happy with the purchase but im not wearing blood stained clothing.

The problem is ebay policy say you have to return in the same condition as you received it.
Too honest definately

Personally I would have sent it back anyway. The seller should have made sure it was clean before listing.
Makes me shudder to think what could be on it.
I am not sure if Trading Standards will deal with it but if you get it back again then you could try opening then dispute in paypal
