&lt;P&gt;&lt;FONT face="comic sans ms,sans-serif" size="3"&gt;I cannot emphasise enough that any communication between the seller and the courier is of no interest to you. The seller is 100% responsible to get the item to you in good, working order and undamaged.&lt;/FONT&gt;&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;&lt;FONT face="comic sans ms,sans-serif" size="3"&gt;If not then there is absolutely no need to "contact him". It is a myth that eBay expects that. You go to the resolution centre [link below] and open a "not as described" case.&amp;nbsp; &amp;nbsp;This [through eBay] lets the seller know there is a problem. He should send a return [prepaid] label to return it to him and if he does not within 8 days then you escalate it to eBay who takes over and may simply refund anyway.&lt;/FONT&gt;&lt;/P&gt;

&lt;P&gt;&lt;FONT face="comic sans ms,sans-serif" size="3"&gt;You have a set time from the advertised delivery date to raise a case in eBay [30 days if I recall] but if that has passed then you have 180 days to do so in Paypal.       <description>&lt;P&gt;I purchased a Sony TC399 tape recorder from a seller called who promised me he would contact his courier when I told him the item was damaged in transit.&lt;/P&gt;
&lt;P&gt;The whole process ground to a halt because I belived he was contacting his courier and the item was insured. The seller used a delaying tactic over Christmas and the end result is I paid £177.00 for a broken recorder. I have cogantive problems and just feel that I have either been to trusting or didn't follow the correct procidure of leaving negative feedback as a way of provocing the correct response.&amp;nbsp;&lt;/P&gt;</description>

      <description>The seller said he can't get any help form Pay Pal or Ebay and has expressed concern that I might ask for more money if he gives me a partial refund.&lt;BR /&gt;I will see what he says tomorrow and if it's more delaying tactics then I will go to Pay Pal</description>

      <description>If you continue to fall to delaying tactics you will lose your money, and will run out of time to open an eBay item not as described dispute as I outlined in my previous post. You'll still be able to open a PayPal one, but will have to pay to return the item by trackable means to the seller.&lt;BR /&gt;&lt;BR /&gt;I don't know what help your seller is expecting to get from eBay or PayPal - this is nothing to do with them. The item arrived damaged, so it either wasn't packaged correctly, which would be the seller's fault, or the courier has damaged it, in which case it's between the seller and the courier.&lt;BR /&gt;&lt;BR /&gt;If you prevaricate, you will lose out. You have 30 days from the delivery date to open an eBay item not as described dispute, the longer you leave it the longer the seller can claim that you've had the item for a while and have damaged it yourself. Open a dispute.</description>
