false listing of a item

Hello a seller has posted an item to Me that I have not paid for

it was ment to be some new ink cartridges but when they arrived they where used and empty

but as I have not paid for the item I cannot get it removed from the shopping basket it still says

pay now the seller says that I do not have to pasy for the item but they are not willing to remove the

item they said thay I can dispose of it but Ebay says pay now and that nothing can be done as I

have not paid but this will leave a unpaid mark aganst Me.

What can be done.

It will not leave an unpaid mark. Only if the seller cancels the sale marking reason as "Buyer did not pay" would you get an unpaid strike.

The logical thing to do is ask the seller to cancel the sale using reason "buyers request".
