      <title>Ebay not applying their own rules !</title>

      <description>&lt;P&gt;Its been a 20 + year ongoing battle dealing with Ebay and 50,000 sales later (I directly or indirectly work on 5 ebay accounts) but the 50,000 sales are personally all mine all packaged by my own hand every one of them. I don't know what action I can take when Ebay have a rule that categorises certain situations - it then admits it can see that the buyer has manipulated (violated) the rule to make me pay for a return. May I add personally it may not have been intentional but Ebay happily admit they can see thats the case but say it may well be the case but sir your gonna pay for it - So Ebay are enforcing that the person that makes the mistake is now paid for by some other innocent part (that being me)&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;They refused to conceed any ground on it stating "thats the way it is" - they even possibly have used the term "thats the rule" but in fact the rule was the opposite and they chose to make me pay instead. I have to say for me thats unacceptable behaviour. Ebay facilitate a contract between the seller and the buyer so for sure not for them to pay for anyone's mistake in that case but not to apply the rule to the person who incorrectly categorised the return so as not to pay for it that stinks in my book. Is there something I'm missing here. Like they are invisibly supporting me and I'm too stupid to see it. They certainly think 5 accounts 100% feedback and 50,000 items later they still have the right to treat me like I'm stupid&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;any ideas&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I don't have a shop or any listing or any trade on any account because of it as I can't acccept it. To me its like allowing them to treat me like trash next time round.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I closed all my trading even pleading with a guy that jointly works with me on 1 account to stop.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Sorry I should have made it clear the return category chosen by the buyer (who had 'zero' feedback) was The item was damaged or didnt work and the reason for that they had written they ordered the wrong part - Ebay stand to make us pay the return carriage even though they agree the buyer mis categorised the return - they conceed no ground&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>

      <description>&lt;P&gt;Ebay never see the item, but if buyer claims not as described it is believed which means seller&amp;nbsp;has to pay return postage.&lt;/P&gt;
&lt;P&gt;It is an unfair system which all sellers have to reluctantly accept or leave ebay.&lt;/P&gt;</description>

      <description>All you can do is accept the return, issue refund when received &amp;amp; report buyer after.&lt;BR /&gt;Afraid to say, you can argue all you want with ebay, but if you fail to refund buyer, ebay will force you to.</description>

      <description>&lt;P&gt;It would help if you had said in exactly which way eBay is breaking its rules.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;The usual problem for sellers is that eBay's rules are themselves often massively biased in favour of the buyer.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;Take the case of any dispute whether an item was as described. EBay's policy is to support the buyer unless they can determine that the description was correct. As eBay never even sees the item, it's almost never able to determine that it was correctly described. In all but name, eBay gives buyers a free 30 day trial period, with buyers being able to claim any fault to return the item at the seller's entire expense.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;Some of the "rules" to protect&amp;nbsp;sellers are simply&amp;nbsp;misleading and meaningless. For example, buyers are supposedly required to return items in the condition received. However, many sellers have still been made to refund buyers even after complaining that their items had been returned damaged, or even switched for another one. This is what eBay reportedly told one seller: "As we didn't see the original item that you sent to the buyer and we didn't see the item the buyer returned to you, we are not in a position to take sides in these situations and verify who has the valid complaint". EBay's idea of not taking sides was to make the seller refund the buyer! Now this policy is NOT stated in the user agreement!&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;We are all required in the user agreement to accept eBay's decisions on all disputes. Because eBay is unregulated (which is scandalous, in my opinion), there is no right to any independent appeal against their decisions. Basically, eBay can do what it wants.&lt;/P&gt;

      <description>Sorry and many thanks for that reply - I did notice your FB is 2 which leads me to ussume im much thicker than i realised its taken me 1000s more sales for me to workout that Ebay dont give a hoot about me as a seller - Its onward about a few weeks from when i threw the towel in and I feel no different about Ebay - I'm not one percent less angry than when I took that measure but luckily I have a life which extends beyond alloowing them to bully and disrespect me every day of my life&lt;BR /&gt;&lt;BR /&gt;Thankyou for the answer</description>
