    <description>No you dont have to accept that.&lt;BR /&gt;Just open the not as described dispute as above and follow the instructions&lt;BR /&gt;You dont have to deal with the seller at all&lt;BR /&gt;&lt;BR /&gt;We would not advise accepting a replacement as they often do not arrive and if they do you are run out of time for a dispsute on ebay&lt;BR /&gt;Just open the dispute for not as described in the resolution centre at the bottom of the page or to the right of the item in your PUrchase History MY item is not as described</description>

&lt;P&gt;Open a not as described dispute at the bottom of the page under Resolution Centre.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;Escalate it&amp;nbsp;after a full 3 days of opening the dispute.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;The seller needs to send a pre paid label for the return.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;If they dont then ebay should when you escalate the dispute.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;Make sure it goes back tracked and that the tracking is in the dispute.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;You have 30 days from the day of delivery to open a dispute in ebay&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;Read up on the Ebay money back guarantee&lt;/P&gt;

      <description>Purchased on the 5th November got it today..... Spent all afternoon trying to set it up but keeps crashing...... emailed buyer and told him what was happening and asked me if i had dropped in water..lol Said he would not refund but would send me another,,,,, surely I don’t have to accept this.</description>
