Buyer Kicking Off
Summary: elite_messiah described an issue with a buyer who claims a pair of surround speakers were damaged and is demanding a refund. The buyer alleges the speakers have an attempted repair and something rattling inside, but elite_messiah contests this and suspects either damage during transit or possible fraud from the buyer's side. tressygirl advised that while eBay often sides with buyers, they should have a record that the item was tampered with, which might invalidate a refund. It is important for elite_messiah to engage with eBay’s automated process if a claim is made.
Good morning folks,
So like many others I have a buyer problem. I sold some good Mission surround speakers working fine and cosmetically good. He has received the speakers and to my horror has sent a photo of a damaged speaker accusing me of it having an attempted repair. He said it had something rattling inside so he had a look. He is demanding a refund. Ive replied and said they where fine and why has he taken the speaker apart and how do I even know it's the said speaker. He is kicking off threatening to get the police etc which I know is nonsense but I'm now concerned that Ebay will side with him as they usually do and I'll end up with a loss here. I've messaged him back today stating I will not get into any argument with him and let Ebay step in here. So to conclude he has either damaged it himself or he is trying a parts scam or it has been damaged in transit which by the way he says the packaging was fine. So does anyone have any advice here as to what I should do and what you think Ebay will decide??
Regards Dom.

OP1 week agoThanks everyone .....ye this is gonna be the last time I sell on ebay. Its just too geared towards the scammer. Its all automated and no one cares anymore. I'll continue with Marketplace and Vinted as I use them aswell but Ebay is always the troublesome one. Ive had so many problems over the years I'm just done. Surprised anyone sells anything on here anymore. No wonder it's not as popular as it used to be.
Regards Dom.

·1 week agoI'd love to be a fly on the wall when he turns up at the Police station to make a report.
Basically, your only option here is to accept the return, supply a pre-paid returns label and then, depending what you get back, report the buyer and argue the toss with eBay as to why he's not entitled to a refund. This all has to be done pretty quickly, so pop back here once you receive your speakers back and we'll advise how to proceed.

·1 week agoUnless it was sent with Simple Delivery and the buyer uses 'Damaged in transit' as the reason for the return request, then you have no option other than to accept the return. If you leave eBay to step in at this stage then they will just find in the buyers favour. How you proceed once you have the item back then depends on what you actually receive.

·1 week agoYou're right about one thing eBay do usually side with the buyer in these cases.
However, if the item is returned damaged you have it in eBay messages that he's taken the item apart , so it's not in the same condition as sent out, and that does invalidate any refund claim under eBay's 30 day MBG policy.
If a case for item not as described is made, don't ignore it , you must accept it, as cases are all automated no human contact, not the time to argue the case!
