VERO - why was my report and appeal not upheld?
Hi all,
I mainly sell on Amazon, sell only my own products which I am the manufacturer of and own the brand name for.
I recently lost the buy box on Amazon for one of my products because the Amazon bots had found it for sale much cheaper on eBay.
I looked at the item on eBay and found a product which I don't sell but which used my brand name and my GS1 EAN in the product identifiers. This also meant that the product reviews that the item had displayed on the listing were for my product and not theirs.
I reported this on the VERO portal citing my trademark id and saying that the trademark and the EAN usage were not authorised, and the reviews on the listing were misleading for customers.
This was rejected, as was my appeal.
I've now got no way to report the listing as no further appeals are required.
I contacted eBay support yesterday and pointed out that the reviews on the listing do not match the product and they said that they would investigate, but the listing is still active (although now out of stock).
Why didn't VERO uphold my report? What else can I do now?
Many thanks,
Damian

Mentor3 months agoAre you a registered VeRO member now?
Usually, if a VeRO member reports an item it gets quickly removed.
I feel that if you get nowhere with eBay you may need the help of a solicitor conversant in copyright (which will be expensive).

OP3 months agoHi, Yes I'm a VeRO member - I've got a login for the VeRO portal and have successfully had listings removed in the past. I do not understand why VeRO haven't taken action against this one.
It uses my trademark, and my EAN without authorisation.
