sold an item, for £280 which arrived damaged the buyer was given a refund by Ebay and kept the item so now im down £280 and i dont have the item!!!

Of course you are not down anything. Ebay refunded not you so you still have the money.

Read the money back guarantee and how items damaged in transitvare dealt with.
