Someone help me please
Summary: hocham88 is experiencing a challenging situation with a return request on eBay for a teddy bear they sold. Despite their account being set to 'no returns' and the product description being accurate, the buyer has falsely claimed the item is defective, specifically regarding a vocal feature that was never advertised. The buyer has also left a negative review, and hocham88 is struggling to resolve the issue through eBay, seeking advice on what to do next.
Please help, I don’t use eBay often and I’ve never had any problems before but right now I have a return request for an item I sold. My account is set to no returns, this buyer has falsely claimed that I sent a defective item which isn’t the case. He’s become rude and slightly aggressive claiming that I have no idea what I’m talking about and said that I’m disappointing his 4 year old daughter. This is all over a £10 build a bear stitch teddy. He’s claiming that every single one he owes talks/makes noise, my listing didn’t state anything about a vocal feature and that it’s an optional extra when purchasing the plush toy in store. I even have the original link to the item on build a bear’s website. He’s made this claim and it says I have to pay for the return when I feel as though that’s not right. I didn’t mislead him, lie to him, send the wrong product or do anything wrong. Why should I have to pay for a return when the main issue comes from his assumptions of toys he already owns??? On top of this he’s now stating that the item isn’t BNWT as it was owned by my sister, I’m selling it on her behalf, he’s saying that this is the third owner as I’m listing it?! The item has never been used/played with it has sat on a shelf untouched! It has all original tags attached, tell me how this is not BNWT? He has now made a negative review on my page saying that I didn’t care and want to listen to him when in reality he messaged me and I responded by telling him that he has purchased the wrong item and that my listing was correct. According to eBay I have until today to resolve this issue, on the return request details my only options are to give a full or partial refund with me paying the postage. I’ve tried all week to get eBay to take action and look at all my evidence but the option doesn’t come up for me at all. I don’t know what to do at this point. Can anyone please point me in the right direction as I’ve had quite enough of this!

Because this is eBay's site and you agreed to accept eBay's rules - which in effect require sellers to accept "not as described" cases and to refund the buyer.
If you want the item back you need to send the buyer a prepaid return label, otherwise eBay will enforce a refund without requiring the buyer to return the item. You will also receive an account defect for failing to resolve the problem with the buyer.
When the case has closed you should have an opportunity to appeal. But there is unlikely to be any meaningful investigation. eBay never sees the items concerned and if it's just the buyer's word against the seller's eBay will find in the buyer's favour.
Nobody says it's fair, but this is how it is on eBay.
