sent incorrect item, 90 days+, how can report seller (repeat offender) and obtain refund | Member To Member Support

Ordered 4 Oct, received incorrect item 17 Oct. Immediately contacted seller to advise, was told correct item would be resent. Ongoing saga of me chasing it up and seller telling me it was on its way. Notice seller has form for this exact approach in feedback. Requested refund in Dec. Seller stopped responding. Refund request now closed and as it's 90+ days since I ordered I can't report the seller or ask ebay to step in. I realise I should have marked it as incorrect item received in Oct and not shown the seller any goodwill. But is there anything I can do at this point?
