Scammed for an iPhone 16 pro max!
Summary: tommygjo shared their experience about being scammed when selling an iPhone 16 Pro Max. They described how the buyer falsely claimed the phone was broken and requested a refund, which was processed despite tommygjo having evidence of the scam. *vyolla* responded by advising them to report the incident to a fraud website and to eBay, mentioning that the outcome might depend on the user's history and whether the buyer has scammed others before. They also suggested blocking the phone using the IMEI number.
so I’ve just been denied my refund and it has been sent back to the buyer without my permission, the item was an iPhone 16 pro max, They purchased it on next day special delivery, which I payed for, and in the spur of the moment I didn’t even think to check their profile. I sent them a message and checked it before I sent it, and for some reason my brain just didn’t click on to the fact he hadn't replied to my message about the purchase.
So I sent it and instantly knew it was a scam, low and behold he requested a refund 2 or 3 days later after letting it sit at the postage location, yep another red flag I just brushed over, he then puts a picture of nothing and says the screen won’t turn on and it’s broken, it’s not, clearly lying, I have a multiple pieces of evidence that it works including a full phone test just 2 months before, in which it was all completely perfect.
So I’m waiting as he sent it on 48 hour tracked obviously, and the cheeky man made me pay for it, but anyway I’d already contacted eBay the day of the refund request and told them it was a scam and I don’t think they will send back the phone, TO WHICH EBAY AGREED WITH ME, and set up a call back on the Wednesday when it arrived, however it only arrived Thursday.
So I ring again, get through etc, speak to people, again they completely agree and understand I have evidence of a the phone not being in the package, as I’d recorded from start to finish of the receiving and opening of the package.
But stupid me listened to eBay and clicked package received when I should have just left it and waited, so I get an email today saying they have released the funds back to him, any idea what happens next, I have hard hard hard proof, undeniable proof that it was a scam!

Mentor1 month agoSorry, it's not quite clear to me - have you received something back?
The usual way forward in these situations is that the seller accepts the return and gets their item back, if it isn’t their item they immediately file a report with Reportfraud (used to be Actionfraud) and get a report number:
https://www.reportfraud.police.uk/
Then click the "Report a problem" link in the eBay case, select "Different item returned" as the reason and provide the Reportfraud reference number and report. This stops the automated returns process that would ultimately force the seller to issue a refund.
Then, someone at eBay reviews the case. As to what happens next depends on a few factors - if the buyer has done this before, if the seller is a long standing eBay member who's had no issues like this before etc. We've seen a good few threads recently here in which the sellers have been in a similar scenario but have not lost out.
Presumably you have the IMEI number for the phone and have reported it as stolen too, to block it?
