SCAMMED AGAIN

I'm absolutely at a loss with eBay ,I bought a pre-order Pokémon stuff from a seller ,item doesn't Get released till 17th July ,seller used his QR code to send me an invoice ,just in a letter not even a box ,I messaged seller asking why he done that as items are showing up as delivered,when not even on market yet and said he sends out pre order invoices with date he will send items and purchase a new QR code on 17th July ,,I checked the other day and he is NO longer on eBay so I made a claim to get my buyer protection in action silly me ,eBay said it's been delivered case closed in favour of Seller ,even though it's super impossible to deliver an item that is not on sale till 17th July ,eBay didn't ask me for any proof of what I said just said delivered end off story ,I'm actually quite annoyed.
Has anyone else been scammed by this guy let me know

Mentor1 month ago@kirmcl_9456 How did you fund that payment? If with a debit or credit card you can issue a not received chargeback via your card provider.

Mentor1 month agoIf you receive anything that isn't the item you've ordered you need to open an eBay return and select 'doesn't match description or photo', if you open an eBay item not received claim you'll lose because there's a tracking number showing delivery.

OP1 month agoSpoke with eBay adviser ,I have now to fill in a police report ? Is this for eBay to collect insurance,What's happened to the many hundreds of ££££££ I have paid in buyers protection,
How can eBay not realise the item CANT be delivered as it has not been released yet,it is due for release on 17th July ,and also seller has left eBay ,has he done this to multiple buyers ? So my buyer protection ( you are fully protected by eBay ) nonsense doesn't always work .
I have 10 days to file a police report and get a crime number then get back to eBay and take it from there , eBay should stop listing pre sales if the seller can list stuff for over a month then just shut their account down ,
I must admit even when speaking to an advisor and telling them yes it says delivered on 16th June but item isn't available till 17th July so I can't have it a No brainer ,rant over

Mentor1 month agoSeller cannot just close their account, only ebay can do that.
Don’t you see that by going along with the seller you are the reason the case closes. “you are fully protected” only applies if you follow the rules.
