my seller has not replaced earring that they agreed were faulty.. now I'm out of time as they have stalled me all along by sounding genuine. what can I do to get my £400 back as Ebay have said my return is closed and the seller taken off

OP1 month agoeven though they were taken off by Ebay. Ebay knew they were faulty.

But a lot of items sold here are not what the seller claimed. eBay warned you in the user agreement that they don't guarantee that items sold here will be truthfully described, safe or even legal.
eBay provides a strong money back guarantee if an item isn't as described. So strong that they almost invariably take the buyer's word against the seller's for faults, and if necessary enforce a refund. But the time limit to claim is clearly stated to be 30 days from delivery.
Unfortunately, like so many other buyers, you allowed your seller to string you along until it was too late to claim. And eBay, as we could have told you, now has no interest.
If only buyers would read the the terms they accepted in the user agreement. Buying from strangers here is risky. eBay is a jungle.

Mentor1 month ago · EditedIf it's been more than 30 days and the return is closed it's too late to do anything via ebay but if it's still within 120 days of payment contact your payment provider and ask about a refund or chargeback.
