Royal Mail delivered item to a recycling bin that was then emptied
Royal Mail delivered an item to the buyer's recycling bin that was then collected.
We have the proof of delivery photo of the box in the bin.
I cannot claim as the seller with Royal Mail directly as the sending customer is eBay, citing "We're sorry, you're unable to proceed as the tracking number indicates you are not eligible to claim. Please contact the sending customer to take this further."
Item was both delivered and lost...
What should the buyer do? Can they claim from eBay?

Mentor5 months agoAs has been said, eBay's money back guarantee only covers non-delivery, not cases where items are tracked as delived but later lost or stolen. They do sometimes change their mind if buyers complain or appeal - have they given you the option to do so?
You may have additional legal rights if the seller is a UK business seller. To put it mildly, leaving it in a waste collection bin hardly seems to fulfil the seller's duty to ensure you recive the item. Although inthe case of delivery services, having rights and being able to enforce them can be two, very different things.
Come to think about it, if it was a private seller using eBay's own simple delivery scheme, shouldn't eBay have some responsibility for the actions of its agents, e.g. couriers or mail delivery services, as business sellers have? I have never thought about this before, something worth looking into!

Mentor5 months agoNeither seller nor the buyer is responsible for where a Postie, Courier person leaves an item, and yes many leave them in unsafe places.
If tracking shows delivery to the name and address of the buyer, no claim for a refund can be made through eBay.
The fight lies with the buyer and the delivery service, hoping they can prove it was left in an unsafe place.
